Федеральный закон, дополнивший Антитрестовский закон Клейтона 1914 г. Практика ценовой дискриминации определена в этом законе более четко. Количественные скидки сверх экономии на издержках, полученные в результате продажи в данных количествах, объявлены незаконными, поскольку являются нечестными брокерскими сделками. Скидки с целью компенсации услуг по продвижению товара на рынок должны быть предоставлены всем покупателям на пропорционально равной основе, а ценовая дискриминация допустима, если произошла с целью противопоставления правильной низкой цене конкурента на тот период времени, пока цена не будет ограничивать конкуренцию.
